इस आदेश में, डीसी कश्यप ने कहा कि 2010 से यह सोसाइटी पूरे शहर में घर-घर कचरा संग्रहण, उठान और निपटान के लिए एकमात्र एजेंसी के रूप में काम कर रही है। “मई 15 से अनिश्चितकालीन हड़ताल शहर भर में कचरा संग्रहण सेवाओं के पूरी तरह से बाधित होने का कारण बनेगी, कई स्थानों पर कचरे का जमावड़ा, सार्वजनिक स्वास्थ्य, स्वच्छता और पर्यावरण सुरक्षा के लिए गंभीर खतरा पैदा करेगी। इससे निवासियों और पर्यटकों को विशेष रूप से चल रहे ग्रीष्मकालीन पर्यटन सीजन के दौरान गंभीर असुविधा होगी” उन्होंने कहा। डीसी ने उल्लेख किया कि एसएमसी के तहत स्वच्छता सेवाओं में लगे कर्मचारी हिमाचल प्रदेश आवश्यक सेवा (निर्वहन) अधिनियम, 1973 के प्रावधानों के तहत आते हैं।
हड़ताल पर जाने से रोकने का कारण
इसके अलावा, डीसी ने कहा कि यह आवश्यक है कि सोसाइटी के कर्मचारियों को हड़ताल पर जाने से रोका जाए ताकि सार्वजनिक व्यवस्था बनी रहे, क्योंकि शहर में कचरा और नगरपालिका ठोस अपशिष्ट को इकट्ठा नहीं किया जा सकता है। नगरपालिका ठोस अपशिष्ट को तुरंत निर्धारित प्रक्रिया के अनुसार इकट्ठा और निपटान किया जाना चाहिए। उन्होंने कर्मचारियों को चेतावनी दी कि इस आदेश की अवहेलना किए बिना किसी उचित कारण के बिना कानूनी कार्रवाई का सामना करना पड़ेगा जैसा कि अधिनियम के प्रावधानों के अनुसार है।
